An application has been made under paragraph 2 of Schedule 6 to the Planning Act 2008( 1 ) to the Secretary of State in accordance with the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011( 2 ) for a non-material change to the A66 Northern Trans-Pennine Development Consent Order 2024( 3 ).
This document is a Statutory Instrument, specifically the A66 Northern Trans-Pennine Development Consent (Amendment) Order 2026, numbered 2026 No. 422, relating to infrastructure planning.
The Secretary of State made this Order on April 15th, 2026, and it came into force the following day, April 16th, 2026.
It enacts changes based on an application submitted under the Planning Act 2008 provisions for non-material changes to the existing A66 Northern Trans-Pennine Development Consent Order 2024.
The Secretary of State, having considered the application and the responses to the publicity and consultation carried out in accordance with regulations 6 and 7 of the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011 has decided to make this Order amending the A66 Northern Trans-Pennine Development Consent Order 2024.
The Secretary of State decided to create this amending Order after reviewing the application and considering feedback received during the mandated publicity and consultation process under the relevant 2011 Regulations.
The Secretary of State, in exercise of the powers in paragraph 2 of Schedule 6 to the Planning Act 2008, makes the following Order.
The Secretary of State exercises the powers granted by paragraph 2 of Schedule 6 of the Planning Act 2008 to officially issue this amending Order.
Citation and commencement
- This Order may be cited as the A66 Northern Trans-Pennine Development Consent (Amendment) Order 2026 and comes into force on 16th April 2026.
Article 1 establishes the official short title of this amending legislation and confirms its commencement date as April 16th, 2026.
Amendment of the A66 Northern Trans-Pennine Development Consent Order 2024
- The A66 Northern Trans-Pennine Development Consent Order 2024 is amended as follows.
Article 2 states that the regulations which follow detail the specific amendments being made to the principal A66 Northern Trans-Pennine Development Consent Order from 2024.
( 1 ) 2008 c. 29. Paragraph 2 of Schedule 6 was amended by paragraph 4 of Schedule 8 to the Marine and Coastal Access Act 2009 (c. 23), by paragraph 72 of Schedule 13 and paragraph 1 of Schedule 25 to the Localism Act 2011 (c. 20), by section 28 of the Infrastructure Act 2015 (c. 7) and by section 128 of the Levelling-up and Regeneration Act 2023 (c. 55).

Certification of new, revised or substituted plans
- -(1) The undertaker must, as soon as practicable after the making of this Order, submit copies of any new, revised or substituted plans to the Secretary of State for certification that they are true copies of the plans referred to in this Order.
(2) A plan so certified by the Secretary of State is admissible in any proceedings as evidence of the contents of the document of which it is a copy.
Article 3 requires the project undertaker to promptly submit any new, changed, or replacement plans to the Secretary of State for formal certification as true copies of the plans referenced in this amending Order.
A plan officially certified by the Secretary of State becomes admissible as legal evidence of its content in any legal proceeding.
Amendment to Schedule 1 (authorised development)
- -(1) In Part 1 of Schedule 1 (authorised development), after paragraph (d) Work No. 0102-1D, insert-
- '(e) Work No. 0102-1D-A - as shown on sheet 2 of the works plans for scheme 0102 and being the construction of additional carriageway and improvements to sections of the existing A66, to include-
- (i) the improvement of the existing A66 eastbound and westbound dual carriageway to the east of the new Kemplay Bank Junction; and
- (ii) the construction of new private means of access to attenuation pond as shown on sheet 2 of the rights of way and access plans for scheme 0102;'.
- (2) Renumber what was paragraph (e) as paragraph (f).
- (3) In Part 2 of Schedule 1, in-
- (a) Work No. 03-9B, sub-paragraph (i), for 'footpath' substitute 'cycle track';
- (b) Work No. 03-9B, sub-paragraph (i), for 'Countess Pillar' substitute 'former Llama Karma Kafe'; and
- (c) Work No. 03-9B, sub-paragraph (ii), after 'improved A66', insert '(including the site of the former Llama Karma Kafe)'.
(4) In Part 3 of Schedule 1 in-
- (a) Work No. 0405-6C, sub-paragraph (iii), after 'lane;' insert 'and';
- (b) Work No. 0405-6C, omit sub-paragraph (iv); and
- (c) Work No. 0405-9, paragraph (a), for 'existing Footpath 336/011' substitute 'Green Land Track'.
Article 4 introduces specific technical amendments to Schedule 1, which details the works authorised by the original DCO. This includes adding a new work item, Work No. 0102-1D-A, related to constructing additional carriageway and improving sections of the A66 east of Kemplay Bank Junction, including access to an attenuation pond.
Further changes affect Scheme 03, updating Work No. 03-9B to change a reference from 'footpath' to 'cycle track' and referencing the 'former Llama Karma Kafe' instead of 'Countess Pillar'.
Scheme 0405 also sees adjustments, such as substituting 'Green Land Track' for an existing footpath reference and omitting one sub-paragraph related to Work No. 0405-6C.
Amendment to Schedule 2 (permanent stopping up of highways and private means of access and provision of new highways and private means of access and provision of new highways and private means of access)

Significant adjustments are made to the linear measurements recorded for the 'Long Marton (Road)', affecting two separate paragraphs relating to associated distances, and the length for 'Reference H*' is slightly reduced from 1.2 km to 1.1 km.

Entries for References 13, 14, 15, 17, 18, 19, 21, 22, 24, and 26 are omitted entirely or modified significantly.
For 'Reference 16', a 'pond' becomes a 'tank' with a reduced length.

Several entries for references 53, 54, and 58 are condensed by omitting descriptions concerning maintenance strips alongside the realigned Long Marton road alignments.
The measurement for 'Reference 59' is substantially reduced from 180 metres to 15 metres, and extraneous directional text is removed.
Amendment to Schedule 7 (classification of roads, etc.)

Article 16 requires that the existing table in Schedule 10, which lists all documents requiring certification, is entirely replaced by the new table provided in the Schedule appended to this amending Order.

[Schedule detailing the substituted table for Schedule 10]
The schedule provides the new, detailed table specifying all the documents relevant to the A66 project that must be formally certified by the Secretary of State, capturing all necessary revisions made by this amending Order.
EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the A66 Northern Trans-Pennine Development Consent Order 2024 (S.I. 2024/360) ('the 2024 Order'), a development consent order under the Planning Act 2008 ('the Act').
The Explanatory Note clarifies that this Order modifies the 2024 Development Consent Order (DCO) made under the Planning Act 2008.
The note explicitly states that it does not form part of the binding legal Order itself.
This Order follows an application under paragraph 2 of Schedule 6 to the Act to make the following non-material changes to the 2024 Order-
- (a) article 4 provides for six amendments to the Work No. descriptions and the insertion of new Work No. 0102-1D-A in Schedule 1 (authorised development);
- (b) articles 5 to 13 provided for amendments to Schedule 2 (permanent stopping up of highways and private means of access and provision of new highways and private means of access). Articles 5 and 6 amend the tables in Parts 1 and 3 that relate to Scheme 03 (Penrith to Temple Sowerby) and articles 7 to 13 amend the tables in Parts 1 and 3 that relate to Scheme 0405 (Temple Sowerby to Appleby) in Schedule 2;
- (c) article 14 provides for five amendments to the measurements of highways set out in Schedule 7 (classification of roads, etc.);
- (d) article 15 provides for four amendments to the measurement of highways set out in Schedule 8 (traffic regulation measures etc.);
- (e) article 3 provides for the certification of new, revised or substituted plans required to show the non-material changes to the 2024 Order; and
- (f) article 16 provides for amendments to Schedule 10 (documents to be certified) required due to the new, revised or substituted plans are set out in the Schedule to this Order. This Order substitutes the table in Schedule 10 for the table in the Schedule to this Order.
This section summarises the scope of the non-material changes implemented by specific articles.
Key changes include new works descriptions in Schedule 1 (Article 4), extensive updates to highway stopping-up and access rights across Schemes 03 and 0405 in Schedule 2 (Articles 5-13), modifications to road classification measurements in Schedule 7 (Article 14), and updates to speed limit measurements in Schedule 8 (Article 15).
It also confirms the requirement for certifying new plans (Article 3) and the subsequent substitution of the list of required certified documents in Schedule 10 (Article 16).
A copy of the substituted plans mentioned in this Order may be inspected free of charge during working hours at the offices of National Highways, Three Snowhill, Snow Hill Queensway, Birmingham, B4 4GA.
The public can view copies of the newly substituted or revised plans, free of charge, during standard working hours at the main offices of National Highways located in Birmingham.
