- These Regulations- (a) may be cited as the Children's Wellbeing and Schools Act 2026 (Commencement No. 2) (England) (Amendment) Regulations 2026, and (b) come into force on the day after the day on which they are made.

Amendment of the Children's Wellbeing and Schools Act 2026 (Commencement No. 2) (England) Regulations 2026
- -(1) The Children's Wellbeing and Schools Act 2026 (Commencement No. 2) (England) Regulations 2026( b ) are amended as follows.
(2) In paragraph (e) of regulation 5 (provisions coming into force on 1st September 2026), after 'section 67 (establishment of pupil referral units)' insert ', only in so far as it relates to pupil referral units in England( c )'.
This section modifies previous regulations to narrow the scope of a specific legal change.
It ensures that the power to establish pupil referral units—which are alternative education settings for children who cannot attend mainstream schools—is only activated for England on the 1 September 2026 start date.
