The Crime and Policing Act 2026 (Commencement No. 3 and Saving Provisions) (Amendment) Regulations 2026
Delayed the implementation of new anti-social behaviour case review procedures that were due to begin on 26 October 2026.
These Regulations postpone the commencement of specific provisions within the Crime and Policing Act 2026 that were originally scheduled to take effect on 26 October 2026.
By amending previous commencement regulations, this instrument prevents Section 6 and Schedule 3 of the Act—which concern the further review of anti-social behaviour cases—from entering into force on that date.
The delay applies to the relevant bodies responsible for anti-social behaviour case reviews in England and Wales and the individuals seeking such reviews.
Arguments For
The explanatory note states that the removal of these specific commencement dates allows for the provisions to be brought into force at a later, unspecified date.
The document indicates that an impact assessment for the broader Crime and Policing Act 2026 was previously conducted, suggesting the policy intent remains consistent with the original Act.
The amendment ensures that Section 6 and Schedule 3 do not take effect prematurely on 26 October 2026 before the government is ready to implement them.
Arguments Against
Legal practitioners or local authorities may face uncertainty regarding the implementation timeline for the new anti-social behaviour case review process.
The document does not specify a new date for when these provisions will come into force, leaving the legal status of the further review process in limbo.
Parties affected by anti-social behaviour who were expecting new review rights to be available from October 2026 will experience a delay in accessing those mechanisms.

Amendment of the Crime and Policing Act 2026 (Commencement No. 3 and Saving Provisions) Regulations 2026
- 2.-(1) The Crime and Policing Act 2026 (Commencement No. 3 and Saving Provisions) Regulations 2026(2) are amended as follows.
- (2) In regulation 4, omit sub-paragraphs (f) and (i).
This section removes two specific sub-paragraphs from the previous commencement order issued earlier in 2026.
The removal of these sub-paragraphs cancels the scheduled activation of Section 6 and Schedule 3 of the Crime and Policing Act 2026.
As a result, the new legal framework for reviewing anti-social behaviour cases and the associated supplementary procedures will not take effect on 26 October 2026.
The legal authority to conduct these specific reviews remains subject to the original 2014 legislation until a new commencement date is set by the Secretary of State.
