The Ecclesiastical Offices (Terms of Service) (Amendment) Regulations 2026

Published: Thu 30th Jul 26

Extended the time limit for ecclesiastical office holders to file Employment Tribunal claims regarding missing written particulars from three months to six months.

These Regulations extend the timeframe for ecclesiastical office holders to refer matters to an Employment Tribunal if they fail to receive required documentation regarding their terms of service. The instrument specifically doubles the period from three months to six months following the termination of an appointment for an office holder to file a reference concerning missing statements of particulars, changes to office, or stipend details.

These changes apply to clergy and other ecclesiastical office holders within the Church of England under the 2009 Regulations.

Arguments For

  • The explanatory note states that the amendment ensures consistency with changes made by the Employment Rights Act 2025, specifically regarding time limits for tribunal references.

  • The document indicates that the extension provides office holders with a longer window to seek legal redress when they have not been provided with a written statement of particulars of office, a statement of changes, or an itemised statement of stipend.

  • The Regulations were approved by the General Synod, the legislative body of the Church of England, following the procedure established in the National Institutions Measure 1998.

Arguments Against

  • Legal commentators might note that while the extension aligns with broader employment law, it may increase the period of legal uncertainty for dioceses or coordinating bodies following the termination of an office holder's appointment.

  • Administrative leads in the Church of England may face challenges in maintaining records for longer periods to defend against potential tribunal references made up to six months after an appointment ends.
