1. Citation, commencement and application
(1) This Order may be cited as the Environmental Civil Sanctions (England) Order 2010 and comes into force on 6th April 2010.
(2) This Order applies in England.

It limits the geographic scope of these regulations to England.
3. Regulators
(1) The Environment Agency is the regulator for the offences under the enactments specified in Schedule 5.
(2) Natural England is the regulator for the offences under the enactments specified in Schedule 6.

7. Fixed monetary penalties

(2) The regulator may only impose a fixed monetary penalty if it is satisfied beyond reasonable doubt that the person has committed the offence.
Regulators are permitted to issue set fines for specific environmental violations.

10. Variable monetary penalties, restoration notices and compliance notices
(1) The regulator may by notice impose a variable monetary penalty, a restoration notice or a compliance notice on a person in relation to an offence specified in Schedule 5 or 6.
This section empowers regulators to use more flexible enforcement tools.
These include fines of varying amounts, orders to repair environmental damage, or requirements to take specific steps to ensure future compliance with the law.
18. Stop notices
(1) The regulator may serve a stop notice on any person in a case where— (a) the person is carrying on an activity and the regulator reasonably believes that the activity as carried on by that person involves or is likely to involve the commission of an offence... and (b) the regulator reasonably believes that the activity as carried on by that person is causing, or presents a significant risk of causing, serious harm to human health or the environment.
Regulators are authorized to issue immediate orders to halt specific activities.
This power applies when there is a reasonable belief that an ongoing activity is illegal and poses a serious threat to the environment or public health.
