The Equality Act 2010 (Code of Practice on Services, Public Functions and Associations) (Commencement) Order 2026
This Order brings into force a revised Code of Practice issued by the Commission for Equality and Human Rights regarding services, public functions, and associations under the Equality Act 2010.
It applies to any person or organization providing services to the public, exercising public functions, or managing associations in England, Wales, and Scotland.
The Order ensures the 2026 Code of Practice takes effect immediately after the revocation of the previous 2011 version, providing a statutory basis for the new guidance to be used in legal proceedings.
Arguments For
The order states that the Commission for Equality and Human Rights published proposals and consulted appropriate persons to ensure the Code's relevance.
Proponents indicate the Code provides updated guidance on the Equality Act 2010, replacing the 2011 version to reflect current legal standards.
The order notes that the Secretary of State consulted with Scottish and Welsh Ministers to ensure cross-border administrative alignment.
The document's preamble confirms the instrument follows the statutory procedure of laying the draft before Parliament for 40 days without disapproval.
Arguments Against
Legal scholars may note that the document does not enumerate specific changes between the 2011 and 2026 versions, requiring users to compare long texts to identify new obligations.
Affected parties, such as small businesses or local associations, may argue that the immediate transition from the revoked code to the new code on August 5th provides limited time for operational adjustments.
Organizations may cite implementation difficulties related to the costs of retraining staff on the updated guidance, as referenced in the mentioned impact assessment.
