The Immigration (Leave to Enter and Remain) (Amendment) Order 2026
This Order amends the Immigration (Leave to Enter and Remain) Order 2000 to lower the minimum age for individuals seeking to enter the United Kingdom via automated gates.
It directs that nationals of countries listed in the 2000 Order may obtain leave to enter as visitors through automated processing from the age of 8, reduced from the previous limit of 10.
The Order applies to the Secretary of State, Border Force officials, and eligible foreign nationals traveling to the United Kingdom.
Arguments For
The explanatory note states that the Order allows individuals aged 8 and older, from specified countries, to use automated gates to obtain leave to enter the United Kingdom as visitors.
The document implies a reduction in administrative barriers for younger travelers by enabling entry without direct authorization from an immigration officer at the gate.
The Secretary of State asserts that no significant impact on the private, voluntary, or public sector is foreseen, justifying the absence of a full impact assessment.
Arguments Against
Legal observers might question whether lowering the age threshold to 8 years old for automated processing sufficiently accounts for child safeguarding risks compared to in-person interviews.
Civil liberties or migrant rights organizations may express concern regarding the accuracy of facial recognition technology when applied to younger children whose physiological features change rapidly.
Critics may argue that the lack of a full impact assessment leaves the actual operational burden on border infrastructure or potential security risks unexamined.

Amendment of the Immigration (Leave to Enter and Remain) Order 2000
- In the Immigration (Leave to Enter and Remain) Order 2000( 2 ), in article 8B (further provision as to automatic grant of leave), in paragraph (2), in sub-paragraph (c), for '10' substitute '8'.
This section modifies the existing legal framework governing automated entry into the UK. It changes the age requirement found in Article 8B of the 2000 Order, lowering the age at which a qualifying person is eligible for the automatic grant of leave via an automated gate from 10 years to 8 years.
This allows younger children from recognized countries to use e-gates rather than seeing a Border Force officer.
