The A47 Wansford to Sutton Development Consent (Revocation) Order 2026

Published: Wed 3rd Jun 26

This statutory instrument formally brings specified sections of the Police, Crime, Sentencing and Courts Act 2022 into effect across England and Wales on 15th February 2024, thereby implementing further provisions of the primary legislation into the criminal and civil justice frameworks.

Arguments For

  • This order facilitates the implementation of overdue provisions within the broader Police, Crime, Sentencing and Courts Act 2022, ensuring legislative intent is fulfilled.

  • Bringing these specific sections into force allows for enhancements to the criminal and civil justice systems in England and Wales, potentially improving public safety or procedural fairness, depending on the specific sections activated.

  • Timely commencement prevents legislative provisions from remaining dormant, thereby realizing policy goals set out when the Act was originally passed.

Arguments Against

  • Commencement orders can introduce new legal obligations or procedural changes with limited lead time, potentially causing unanticipated burden or confusion for police forces, courts, or the public.

  • If the operational readiness of implementing bodies (like police forces or the Crown Prosecution Service) has not been fully assured, premature commencement could lead to inconsistent or ineffective application of the new powers or rules.

  • Each commencement requires administrative oversight and resource allocation; if the sections commenced are minor or low priority, the administrative effort might outweigh immediate practical benefit.
