The Port of Tyne Harbour Revision Order 2026

Modernised the Port of Tyne's governance structure, consolidated statutory harbour powers, and updated the Authority's regulatory and financial framework.

The Port of Tyne Harbour Revision Order 2026 establishes a revised constitution for the Port of Tyne Authority and defines the updated geographic and legal limits of its jurisdiction.

It grants the Authority specific powers regarding financial management, including borrowing and the maintenance of a reserve fund, and authorises the collection of various dues and charges.

The order empowers the harbour master to issue general and special directions to vessels and vehicles for safety and efficiency, while also establishing mandatory advisory bodies to represent port stakeholders.

It applies to the Port of Tyne Authority, vessel masters, port users, and relevant statutory undertakers within the defined port limits.

Arguments For

  • The order states it is necessary to modernise and consolidate the statutory harbour powers applying to the Port of Tyne.

  • Proponents argue the legislation provides a modern suite of charging and borrowing powers to ensure the efficient financial management of the port undertaking.

  • The document asserts that the updated constitution and appointment procedures for the Authority will facilitate effective and economic discharge of port functions.

  • The order specifies that the powers of general and special direction are required for the ease, convenience, and safety of navigation and port operations.

Arguments Against

  • Legal scholars may note that the order grants the Authority significant discretion to delegate statutory port functions to private companies under article 43.

  • Affected parties might express concern regarding the increased maximum fines (level 4 on the standard scale) for non-compliance with harbour master directions.

  • Commercial operators could question the requirement for annual bunkering licences and the associated fees prescribed under article 47.

  • Property owners near the port may find the Authority's power to require repairs to private landing places under article 50 to be an encumbrance on private property rights.
