This Order, made by the Office for Students under powers granted by the Higher Education and Research Act 2017, formally amends the Power to Award Degrees etc. (ESCP Europe Business School) Order 2024 by substituting Article 3 to extend the fixed term authorization for ESCP Europe Business School to award degrees.
Specifically, the Order changes the expiry date of this authorization for ESCP Europe Business School (UKPRN: 10002313) from December 2, 2027, to December 2, 2030.
Arguments For
The extension provides continued regulatory stability for ESCP Europe Business School (UKPRN: 10002313), allowing it to maintain its educational offering without interruption.
Extending the fixed term allows the institution sufficient time to meet long-term quality and standards requirements set by the Office for Students (OfS), following the advice received from the relevant body.
Updating the expiry date ensures that the process for renewal or permanent authorization can occur closer to the final date of 2030, providing a longer operational runway.
Arguments Against
The amendment alters a previously specified term without clearly detailing the specific grounds or improvements made by ESCP Europe Business School justifying the three-year extension from the original 2027 deadline.
Extending the temporary authorization raises questions about the timeline for granting full, permanent degree-awarding powers, suggesting a potential ongoing reliance on provisional status.
Regulatory changes, even administrative ones like this, consume administrative resources within the OfS and the Higher Education sector, requiring oversight for the modified order.
The Office for Students, in exercise of the powers conferred by sections 42(1), 43(1), and 44(1) of the Higher Education and Research Act 2017, makes the following Order.
The Office for Students (OfS) is exercising its authority granted by specific sections (42(1), 43(1), and 44(1)) of the Higher Education and Research Act 2017 to establish this legal instrument.
The Office for Students has requested advice from the relevant body regarding the quality of, and standards applied to, higher education provided by the provider and has had regard to that advice in accordance with section 46(1)(b) and 46(7) of that Act.
Before issuing this Order, the OfS sought and considered advice from the appropriate regulatory body concerning the quality and standards of higher education delivered by the institution involved.
The Office for Students has complied with the procedure on giving notifications in accordance with section 48 of that Act.
The OfS confirms it followed the official requirements for issuing notifications as prescribed under section 48 of the governing Act.
- Citation and commencement
This Order may be cited as the Power to Award Degrees etc. (ESCP Europe Business School) (Amendment) Order 2025 and shall come into force on 4th December 2025.
This established the official title of this legal document as the Power to Award Degrees etc. (ESCP Europe Business School) (Amendment) Order 2025.
It also specifies that the Order legally takes effect from December 4, 2025.
- Variation of the Power to Award Degrees etc. (ESCP Europe Business School) Order 2024
This section signals the primary purpose of the Order: to change or adjust the content of the previous legal instrument concerning ESCP Europe Business School's degree-awarding powers made in 2024.
(1)
The Power to Award Degrees etc. (ESCP Europe Business School) Order 2024 is varied in accordance with paragraph (2).
This confirms that the 2024 Order relating to ESCP Europe Business School's authorization is being legally modified according to the instructions detailed in the subsequent paragraph (2).
(2)
For article 3, substitute––
“3. The authorisation in article 2 is for a fixed term beginning on 2nd September 2024 and expiring at the end of the day on 2nd December 2030.”
This critically replaces the original Article 3 of the 2024 Order.
The new definition sets the fixed period for the degree-awarding authorization, commencing on September 2, 2024, and now ending on December 2, 2030.
