The Welfare Reform Act 2012 (Commencement No. 30 and Transitory Provisions) (Amendment) (England) Order 2026

This Order terminates the temporary protection of free school lunch eligibility for certain students in England starting 17 August 2026.

It amends the Welfare Reform Act 2012 (Commencement No. 30 and Transitory Provisions) Order 2018 by revoking the 'transitory provisions' that previously allowed individuals to retain their free meal status despite changes to the welfare system.

The Secretary of State for Education directs that any person relying on these specific transitional rules to qualify for free school lunches will cease to be eligible on the specified date.

Arguments For

  • The order identifies that the transitory provisions established in 2018 were temporary measures intended to preserve eligibility during the rollout of Universal Credit.

  • The explanatory note states that the Order executes provisions within the Welfare Reform Act 2012 designed to withdraw specific eligibility criteria once the transitional period concludes.

  • Proponents may argue that the measure aligns free school meal eligibility with the fully implemented Universal Credit framework, ensuring consistent application of the means-test across the student population.

Arguments Against

  • Anti-poverty advocates may argue that withdrawing eligibility will increase financial pressure on low-income families who previously relied on the 2018 protections.

  • Educational organizations might raise concerns regarding the administrative burden of reassessing students who lose their preserved status on 17 August 2026.

  • Legal analysts may note that the Order creates a hard cutoff date, which could lead to a sudden loss of benefits for households whose income fluctuates near the eligibility threshold.
