The Childcare (Miscellaneous Amendments) (England) Regulations 2026
These Regulations amend several existing statutory instruments to update childcare registration and welfare requirements in England.
The legislation prohibits the presence of banned dog breeds at childcare premises, lowers the threshold for notifying the Chief Inspector of child abuse or harm by removing the qualifier 'serious', and adopts updated statutory frameworks for learning, development, and staff qualifications.
It applies specifically to early years childminders, group and school-based providers, later years providers, and home child-carers registered on both the Early Years and General Childcare Registers.
Arguments For
The document states that these amendments update the Early Years Foundation Stage (EYFS) statutory frameworks, bringing them into alignment with revised versions dated 13th July 2026.
Proponents within the Department for Education indicate that the regulations clarify safe sleep requirements for early years providers and English qualification requirements for staff ratios.
The legislation establishes a specific prohibition on banned dog breeds at childcare premises to ensure registration requirements are consistent with the Dangerous Dogs Act 1991.
The document notes that removing the word 'serious' from notification requirements regarding child harm expands the scope of incidents that must be reported to the Chief Inspector or childminder agencies.
The explanatory note asserts that the amendments improve safety by extending notification requirements for adults living or working on domestic premises to a broader range of childcare providers.
Arguments Against
Legal observers might note that the regulations impose new obligations on home child-carers (nannies) to ensure, so far as reasonably practicable, that no banned dog breeds are present at a third-party's premises, which may be difficult to control.
Affected parties may argue that the change from reporting 'serious harm' to any 'harm' creates an increased administrative burden for providers and the Chief Inspector due to a higher volume of required notifications.
Providers of 'childcare on domestic premises' may find the requirement to report every change of person aged 16 or older living or working on the premises to be an additional regulatory hurdle not previously applied to them in this specific form.
