The Energy Prices Act 2022 (Extension of Time Limit) (No. 2) Regulations 2026

Published: Wed 9th Sept 26 Came into force: Sat 24th Oct 26

Extended the sunset date for the government's energy cost support powers by six months to 25 April 2027.

These Regulations extend the period during which the Secretary of State may exercise powers under section 13 of the Energy Prices Act 2022 to provide financial support for energy costs.

By moving the expiration date from 25 October 2026 to 25 April 2027, the instrument allows the Department for Energy Security and Net Zero to continue funding a portion of the Renewables Obligation costs normally passed to consumers.

This authority applies to the Secretary of State and affects domestic electricity suppliers who receive grant funding to lower household energy bills.

Arguments For

  • The Explanatory Memorandum states that the extension is necessary to continue the 'RO to Exchequer' policy, which funds 75% of the Renewables Obligation costs for domestic energy supply.

  • The department reports that this policy, combined with the discontinuation of the Energy Company Obligation scheme, results in an average £150 reduction in domestic energy bills.

  • Proponents argue the measure addresses persistently high energy prices and provides significant benefits to low-income and fuel-poor households during cost-of-living pressures.

  • The government asserts that the extension is a required interim measure until new primary legislation can be introduced to provide a permanent legal basis for these energy grants.

Arguments Against

  • The government acknowledges that the policy may lead to an increase in greenhouse gas emissions due to the 'rebound effect' where lower prices result in higher energy consumption.

  • Legal or procedural concerns could be raised regarding the repeated use of temporary six-month extensions for a multi-year policy instead of permanent primary legislation.

  • The department notes that while the policy provides bill relief, it involves a substantial transfer of approximately £6.7 billion from the Exchequer to energy bill payers over three years.

  • Some parties may cite administrative burdens placed on the Department for Energy Security and Net Zero and Ofgem to manage and enforce the grant scheme.

1.—(1) These Regulations may be cited as the Energy Prices Act 2022 (Extension of Time Limit) (No. 2) Regulations 2026 and come into force on 24th October 2026.

(2) These Regulations extend to England and Wales, Scotland and Northern Ireland.

  1. The period referred to in paragraph 7(1) of Schedule 6 to the Energy Prices Act 2022— (a) does not end on 25th October 2026, and (b) instead ends on 25th April 2027.
