The Pedicabs (London) (Amendment) Regulations 2026
Updated insurance requirements, booking procedures, and commencement dates for the regulation of London pedicabs.
These Regulations amend four statutory instruments governing pedicab vehicles, drivers, operators, and fares in London to refine licensing requirements and enforcement powers.
The document grants Transport for London (TfL) the authority to specify insurance requirements for all licensees, replaces fixed £5,000,000 indemnity minimums with TfL-determined standards, and mandates that operators record booking details before a journey begins.
It also expands TfL's power to share information provided by applicants with the police and fire services, requires drivers to carry vehicle insurance certificates, and delays the commencement of certain licensing and fare provisions until 27 November 2026.
Arguments For
The Explanatory Note states that replacing fixed indemnity limits with insurance "as specified by TfL" provides flexibility to ensure licence holders have the most appropriate coverage.
The document indicates that requiring operators to record booking particulars before a journey commences improves record-keeping standards.
Transport for London asserts that expanding information-sharing powers allows for critical safety data, such as battery storage details or motor modifications, to be shared with the London Fire Brigade and the police.
The Regulations seek to eliminate regulatory duplication by removing the requirement for operators to provide vehicle storage locations already captured under vehicle licensing rules.
Arguments Against
Legal scholars might question the broad discretion granted to Transport for London to specify insurance requirements without defined minimum statutory protections for passengers.
Pedicab operators may find the requirement to record all booking details prior to the start of a journey difficult to implement for spontaneous street-side hires.
Privacy advocates could raise concerns regarding the expanded powers for TfL to share "any other information" provided by applicants with third-party bodies beyond what was originally specified.
The delay in the commencement of licensing and fare regulations from October to November 2026 could be cited by residents or businesses as a setback in establishing oversight of the sector.
Citation and commencement
- These Regulations may be cited as the Pedicabs (London) (Amendment) Regulations 2026 and come into force on 27th October 2026.
This section establishes the official name of the regulations and sets the date they become legally active. The regulations take effect on 27 October 2026.
Interpretation
- In these Regulations-
"the drivers regulations" means the Pedicab Drivers (London) Regulations 2026(b);
"the fares and fees regulations" means the Pedicabs (London) (Fares and Fees) Regulations 2026(c);
"the operators regulations" means the Pedicab Operators (London) Regulations 2026(d);
"the vehicles regulations" means the Pedicab Vehicles (London) Regulations 2026(e).
This section defines the four existing sets of 2026 regulations that this document intends to modify.
These definitions ensure that subsequent references to drivers, fares, operators, or vehicles relate to the specific London-based regulatory frameworks established earlier that year.
PART 2
AMENDMENT OF THE VEHICLES REGULATIONS 2026
Amendment of the vehicles regulations
- The vehicles regulations are amended in accordance with regulations 4 to 6.
Amendment to regulation 2
- In regulation 2 (interpretation) of the vehicles regulations, after the definition of "the appropriate fee", insert-
""authorised officer" means a person authorised in writing by TfL for the purposes of these Regulations;
"driver" means a person licensed by TfL to drive the pedicab under the Pedicab Drivers (London) Regulations 2026;".
These provisions add new definitions to the vehicle licensing framework.
An "authorised officer" is defined as anyone given written permission by TfL to enforce these rules, and a "driver" is defined as a person holding a specific TfL-issued pedicab licence.
Amendment to regulation 4
- In regulation 4(12) (London pedicab vehicle licence applications) of the vehicles regulations omit "under this regulation" and insert "or otherwise provided to it in accordance with this regulation (including any change in that information)".
This amendment expands the scope of information that TfL can share with other bodies.
It allows TfL to share not only the initial application data but any subsequent information or updates provided by the vehicle owner.
Amendment to regulation 5
6.—(1) Regulation 5 (London pedicab vehicle insurance) of the vehicles regulations is amended as follows.
(2) In paragraph (1), omit "to carry passengers for hire or reward" and insert "as specified by TfL".
(3) After paragraph (1) insert-
"(1A) A person to whom a London pedicab vehicle licence is issued must-
- (a) produce the certificate of insurance held in accordance with paragraph (1) for inspection when requested to do so by a police constable or authorised officer;
- (b) provide a copy of the certificate of insurance held in accordance with paragraph (1) to the driver of the pedicab vehicle.".
This section changes how insurance is regulated for pedicab vehicles, moving from a general requirement to carry passengers to a requirement to meet standards specifically defined by TfL. It also introduces a legal duty for vehicle owners to show their insurance certificate to police or TfL officers and to give a copy to the person driving the vehicle.
PART 3
AMENDMENT OF THE DRIVERS REGULATIONS 2026
Amendment of the drivers regulations
- The drivers regulations are amended in accordance with regulations 8 to 10.
Amendment to regulation 1
- In regulation 1(3) (citation and commencement) of the drivers regulations omit "30th October" and insert "27th November".
Amendments to regulation 2
- In regulation 2 (interpretation) of the drivers regulations, after the definition of "TfL", insert-
""vehicle insurance" means the insurance held under regulation 5(1) (London pedicab vehicle insurance) of the Pedicab Vehicles (London) Regulations 2026(a).".
This part delays the start date for certain driver licensing rules from 30 October to 27 November 2026.
It also clarifies that references to "vehicle insurance" in driver rules mean the specific insurance required by the vehicle licensing regulations.
Amendments to regulation 5
10.—(1) Regulation 5 (London pedicab driver's licence: general) of the drivers regulations is amended as follows.
(2) In paragraph (6) omit "against public liability risks which provides a minimum indemnity of £5,000,000 in respect of any one event" and insert "as specified by TfL".
(3) In paragraph (8)-
- (a) after "possession" insert "— (a)";
- (b) after "paragraph (6)" omit "when driving a pedicab or plying for hire" and insert-
"; and
- (b) a copy of the certificate of vehicle insurance".
(c) for "it" substitute "them"."
This section removes the specific £5 million public liability insurance minimum for drivers, replacing it with a requirement to meet whatever insurance standards TfL sets.
Drivers are now legally required to carry two documents while working: their own insurance certificate and a copy of the vehicle's insurance certificate.
PART 4
AMENDMENT OF THE OPERATORS REGULATIONS 2026
Amendment of the operators regulations
- The operators regulations are amended in accordance with regulations 12 to 15.
Amendment to regulation 1
- In regulation 1 (citation and commencement) of the operators regulations, in paragraph (2)(b), omit "30th October" and insert "27th November".
Amendment to regulation 2
- In regulation 2 (interpretation) of the operators regulations, after the definition of "associated person", insert-
"authorised officer" means a person authorised in writing by TfL for the purposes of these Regulations.
These regulations postpone the commencement of major parts of the operator licensing framework to 27 November 2026.
They also introduce the definition of an "authorised officer" into the operator-specific rules to permit enforcement by TfL-designated staff.
Amendment to regulation 16
- In regulation 16 (particulars of pedicab bookings) of the operators regulations, at beginning, omit "An" and insert "Before the commencement of a journey, an".
This amendment changes the timing requirement for booking records.
Operators must now ensure that the specific details of a pedicab hire are entered into their records before the trip actually begins.
Amendment to the schedule
15.—(1) The schedule (further requirements) to the operators regulations is amended as follows.
(2) In paragraph 5, after "insurance" omit "against public liability risks which provides a minimum indemnity of £5,000,000 in respect of any one event." and insert-
"-
- (a) as specified by TfL;
- (b) produce the certificate of insurance held in accordance with this paragraph for inspection when requested to do so by a police constable or authorised officer; and
- (c) provide a copy of the certificate of insurance held in accordance with this paragraph to the pedicab driver and the pedicab vehicle licence holder if required to do so by TfL.".
(3) In paragraph 10 omit ", including the location of storage facilities for pedicab vehicles which it controls or manages".
This section removes the £5 million insurance minimum for operators, requiring instead insurance specified by TfL. Operators must produce certificates for inspection and share them with drivers or vehicle owners if TfL requires; it also removes the requirement for operators to report vehicle storage locations to avoid doubling up on information already collected elsewhere.
PART 5
AMENDMENT OF THE FARES AND FEES REGULATIONS
Amendment of the fares and fees regulations
- The fares and fees regulations are amended in accordance with regulation 17.
Amendment to regulation 1
17.—(1) Regulation 1 (citation and commencement) of the fares and fees regulations is amended as follows.
(2) In paragraph (2)-
- (a) after sub-paragraph (a) omit "and";
- (b) in sub-paragraph (b)-
- (i) omit "3" and insert "6 to 8 and 10"; and
- (ii) at end omit the full stop and insert "; and";
- (c) after sub-paragraph (b) insert-
"(c) Regulations 3 to 5 and 9 come into force on 27th November 2026.".
This section adjusts the rollout schedule for the regulations governing pedicab fares and licensing fees.
While some parts may proceed earlier, specific regulations (3 through 5 and 9) are delayed until 27 November 2026.
