The Net Zero Teesside (Amendment) Order 2026

Increased the permitted inner diameters for the heat recovery steam generator and absorber stacks at the Teesside infrastructure site.

This Order modifies the design parameters for the Net Zero Teesside carbon capture and power project by increasing the permitted inner diameters of two specific stacks.

It directs that the inner diameter for the heat recovery steam generator stack be increased from 6.5 meters to 9.0 meters and the absorber stack be increased from 6.6 meters to 7.0 meters.

The order applies to the developers and operators authorized under the original 2024 development consent order, administered by the Department for Energy Security and Net Zero.

Arguments For

  • The order states that the Secretary of State considered the application and responses to publicity and consultation required by the 2011 Regulations.

  • The document asserts that the changes are not materially different from those proposed in the initial application for the non-material change.

  • Proponents of the order rely on powers granted under paragraphs 2(1) and (9) of Schedule 6 to the Planning Act 2008 to modify existing development consent orders.

Arguments Against

  • Legal challenges to non-material change orders often focus on whether the alterations are sufficiently minor to bypass the more rigorous examination required for material changes.

  • Environmental groups or local residents might raise concerns regarding the impact of increased stack diameters on visual amenity or emissions dispersion compared to the original consent.

  • Technical experts could question whether the increase in inner diameters from 6.5m to 9.0m and 6.6m to 7.0m implies a larger operational scale than originally assessed.

Citation and commencement

  1. This Order may be cited as the Net Zero Teesside (Amendment) Order 2026 and comes into force on 29th July 2026.
