The Strategic Planning (Costs of Public Examinations) (Standard Daily Amount) (England) Regulations 2026
Established a £993 standard daily fee for inspectors conducting strategic planning public examinations in England effective 26 November 2026.
These Regulations establish a standard daily fee of £993 that the Secretary of State may recover for the costs of persons appointed to hold public examinations under the Planning and Compulsory Purchase Act 2004.
The fee applies to inspectors conducting examinations of spatial development strategies or revisions to such strategies in England.
The regulations authorize the charging of this fixed amount for every day the appointed person spends holding the examination or performing related work, or a proportional amount for partial days.
Arguments For
The document establishes a uniform daily rate of £993 to ensure consistency in the recovery of costs for public examinations conducted under the Planning and Compulsory Purchase Act 2004.
The explanatory note states that the regulations allow for the charging of an "appropriate proportion" of the daily rate, providing flexibility for work that does not occupy a full day.
Proponents argue that setting a standard amount provides financial predictability for local authorities or bodies responsible for the costs of these examinations.
The government asserts that a full impact assessment was not required because the instrument is foreseen to have no significant impact on the private, voluntary, or public sectors.
Arguments Against
Legal observers may note that the regulations do not specify how an "appropriate proportion" of the £993 fee is calculated for partial days, potentially leading to inconsistent billing practices.
Local authorities may express concern regarding the budgetary impact of the £993 daily rate, particularly for lengthy or complex examinations that require extensive preparatory work.
Critics might question the lack of a formal impact assessment, arguing that even if the individual impact is deemed minor, the cumulative cost of strategic planning examinations across all English authorities could be substantial.

Standard daily amount
- 2.—(1) In relation to a specified examination carried out by a person appointed by the Secretary of State, the standard daily amount prescribed under section 303A(5) of the Town and Country Planning Act 1990 is £993, or an appropriate proportion of that amount in relation to part of a day.
- (2) In this regulation, "specified examination" means a public examination under section 12I or 12P(6)(a) of the Planning and Compulsory Purchase Act 2004(2).
This section sets a fixed daily rate of £993 for inspectors appointed by the Secretary of State to conduct specific planning examinations.
The rate covers both the actual hearing days and any associated work time, allowing for pro-rated charges if only part of a day is worked.
It specifically applies to public examinations of spatial development strategies as defined by the Planning and Compulsory Purchase Act 2004.
