The West Midlands Rail Freight Interchange (Amendment No. 2) Order 2025

Published: Fri 11th Apr 25

The West Midlands Rail Freight Interchange (Amendment No. 2) Order 2025 amends the 2020 Order.

It replaces the table of certification documents in Schedule 15 with an updated version, reflecting changes to plans and their revision numbers.

The amendment follows an application for a non-material change to improve the project's administrative efficiency, and it comes into effect on April 11th, 2025.

Arguments For

  • Intended Benefit: Streamlines the certification process for the West Midlands Rail Freight Interchange project by updating the list of required documents and their revisions.

  • Legal/Historical Basis: The amendment is made under the powers conferred by paragraph 2 of Schedule 6 to the Planning Act 2008, following an application for a non-material change to the original 2020 Order.

  • Implementation Methods: The order directly replaces the existing table in Schedule 15 of the 2020 Order with a revised table, ensuring clarity and accuracy of required documentation.

Arguments Against

  • Potential Impacts: Minimal direct impact, primarily affecting administrative processes related to documentation for the project. Any unintended effects likely to be minor.

  • Implementation Challenges: The main challenge lies in ensuring accurate dissemination of the updated documentation requirements to all relevant parties involved in the project.

  • Alternative Approaches: The alternative would be to maintain the outdated table, potentially leading to delays and inefficiencies in the project's administrative processes.
