The Personal Injuries (NHS Charges) (Amounts) (Amendment) Regulations 2025
These regulations, effective October 1, 2025, amend the 2015 Personal Injuries (NHS Charges) Regulations by increasing charges for NHS ambulance services, outpatient, and inpatient treatment received by those compensated for injuries.
The maximum charge also increases.
The amendments reflect updated costs, are legally authorized under the Health and Social Care Act 2003, and resulted in the revocation of the 2024 amending regulations.
A full impact assessment was deemed unnecessary.
Arguments For
Increased Revenue for the NHS: The increased charges will generate more revenue for the NHS, potentially improving its financial stability and allowing for better provision of healthcare services.
Fair Cost Recovery: The updated charges aim to ensure a fairer recovery of costs associated with providing NHS treatment to individuals who receive compensation for their injuries.
Statutory Authority: The regulations are made under the powers conferred by the Health and Social Care Act 2003, providing a clear legal basis for the changes.
Transparency and Predictability: The published table of charges offers transparency and predictability regarding the costs individuals may face.
Arguments Against
Increased Burden on Injured Individuals: Higher charges may create a financial burden on individuals already dealing with the consequences of their injuries.
Potential for Injustice: The increased charges could disproportionately affect vulnerable individuals or those with limited financial resources.
Administrative Complexity: Implementing and managing the updated charges may add to the administrative workload for NHS bodies.
Lack of Impact Assessment: The absence of a full impact assessment raises concerns that potential negative effects on individuals and the healthcare system may not have been fully considered.

Explanatory Note (This note is not part of the Regulations) These Regulations amend the Personal Injuries (NHS Charges) (Amounts) Regulations 2015 (S.I. 2015/295) (“the principal Regulations”) which make provision about the charges payable under the scheme for the recovery of NHS charges in cases where an injured person who receives a compensation payment in respect of their injury has received NHS hospital treatment or ambulance services. Regulation 2 amends the principal Regulations by substituting a table in Schedule 1. This table provides for increased charges in respect of injuries which occur on or after 1st October 2025. Where the injured person is provided with NHS ambulance services, the charge will be £267 (compared with £256, for injuries incurred between 1st October 2024 and 30th September 2025). Where the injured person receives NHS treatment at a hospital, but is not admitted to hospital, the charge will be £883 (compared with £848 for injuries incurred between 1st October 2024 and 30th September 2025). The daily charge for NHS in-patient treatment will be £1,085 (compared with £1,042 for injuries incurred between 1st October 2024 and 30th September 2025). The maximum charge in respect of an injury will be £64,856 (compared with £62,272 for injuries incurred between 1st October 2024 and 30th September 2025). Regulation 3 revokes the Personal Injuries (NHS Charges) (Amounts) (Amendment) (No.2) Regulations 2024 (S.I. 2024/895). A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

It clarifies that the amendments increase charges for NHS services related to compensated injuries, from October 1st, 2025, specifying the amounts for ambulances, outpatient and inpatient care, as well as the overall maximum charge.
It also notes the revocation of the 2024 regulations and states that a full impact assessment was not considered necessary.
