The Registration of Marriages and Civil Partnerships (Registration Provisions) (Amendment) Regulations 2025
These regulations, effective May 27, 2025, amend the Registration of Marriages Regulations 2015 and the Civil Partnership (Registration Provisions) Regulations 2005.
The changes mandate new forms for marriage and civil partnership registrations, incorporating requirements from the Victims and Prisoners Act 2024.
These additions require the responsible authority statement to specify whether a detained individual is serving a whole life sentence and if subject to a whole life order.
The changes apply to England and Wales, and updated Welsh language forms are also included.
Arguments For
Improved accuracy and compliance: The amendments ensure that required information about a detained person's sentence (whole life sentence and whether subject to a whole life order) is consistently included in marriage and civil partnership notices.
Consistency with Victims and Prisoners Act 2024: These regulations align with the updates to the Marriage Act 1949 and Civil Partnership Act 2004, ensuring a streamlined and legally compliant process for registering marriages and civil partnerships involving detained individuals.
Enhanced record-keeping: The updated forms provide a clearer and more comprehensive record of relevant information for both marriage and civil partnerships, including those involving detained persons.
Legal basis in existing legislation: The amendments are made under the powers granted by the Marriage Act 1949, the Civil Partnership Act 2004 and the Welsh Language Act 1993, providing strong footing for the legal change.
Arguments Against
Administrative burden: Implementing the new forms and updating processes may place an additional administrative burden on registration offices.
Potential for delays: The additional information requirements could potentially introduce slight delays in the registration process for marriages and civil partnerships involving detained individuals.
Minimal impact and lack of assessment: The explanatory note indicates no significant impact was foreseen, which may lead to consideration that further impact assessment could offer a more comprehensive understanding of potential problems.
Alternative approaches to information gathering: There could be alternative ways to gather the required information on sentence details, which have not been explored in this legislation amendment.
