These Regulations, made under powers in the Sentencing Act 2020, amend previous regulations from 2023 and 2024 concerning special procedures applied to community orders and suspended sentence orders.
Specifically, the amendment extends the qualification period for these special procedures for both sets of previous regulations until March 31, 2029, ensuring that specified cases continue to receive this treatment if the relevant order is made by that date.
Arguments For
Extends the duration of special procedures for community and suspended sentence orders under the Sentencing Act 2020, ensuring continued application for offenders sentenced up to March 31, 2029.
Provides necessary administrative consistency by aligning the expiry timelines of the 2023 and 2024 Regulations, which previously had different implicit cut-off dates.
Maintains legislative continuity regarding a specific sentencing measure established under Section 395A of the Sentencing Act 2020.
Arguments Against
Modifies existing regulations (2023 and 2024) whose initial time limits may have implied a sunset for these specific special procedures, potentially extending measures beyond initial legislative intent.
Creates a fixed end date (March 31, 2029) for this extension, necessitating future legislative action to review or further amend the procedural treatment of these sentencing orders past that date.
Alters procedural deadlines for orders in England and Wales, which requires administrative adaptation by the courts and probation services.
The Secretary of State makes these Regulations in exercise of the powers conferred by section 395A(1) and (5) of the Sentencing Act 2020.
The Secretary of State created these rules using legal authority granted by subsections (1) and (5) of section 395A found within the Sentencing Act 2020.
Citation, commencement and extent 1.
(1) These Regulations may be cited as the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) (Amendment) Regulations 2025.
(2) Subject to paragraph (3), these Regulations come into force on 13th December 2025.
(3) Regulation 2 comes into force on 25th December 2025.
(4) These Regulations extend to England and Wales.
The first regulation sets out the official title of this legislation, which is necessary for referencing it.
It specifies that most of the regulations become legally effective on December 13, 2025, but Regulation 2 starts slightly later, on December 25, 2025.
Finally, it states that these rules only apply to legal matters within England and Wales.
Amendment of the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) Regulations 2023 2. In the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) Regulations 2023, in regulation 3, for the words from “of” to “force” substitute “beginning with the day on which these Regulations come into force and ending with 31st March 2029”.
This regulation directly modifies the 2023 Regulations concerning special sentencing procedures.
It revises regulation 3 by replacing the existing text describing the time frame with a new definition.
The new timeframe dictates that the special procedures apply to orders made from the day these current amending regulations come into effect, extending up to and including March 31, 2029.
Amendment of the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) Regulations 2024 3. In the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) Regulations 2024, in regulation 3, for the words from “of” to “force” substitute “beginning with the day on which these Regulations come into force and ending with 31st March 2029”.
This instruction similarly amends the Sentencing Act 2020 (Special Procedures for Community and Suspended Sentence Orders) Regulations 2024.
It updates regulation 3 in those 2024 regulations using the identical replacement text.
This action mandates that the special procedures for these cases now also remain applicable until March 31, 2029.
